What is Delta-9?
While the name may sound unfamiliar or even a little intimidating, Delta-9 is much more approachable than you think. Delta-9 THC is the primary psychoactive compound in cannabis. We understand that this raises questions: Is it legal? How does it feel? What makes it different?
Delta-9 THC has found a legal path through hemp-derived formulations. The 2018 Farm Bill effectively opened the door to the legalization of Delta-9 as long as it comes from hemp, which is another variation of the Cannabis sativa plant. As of April 2025, Delta-9 is fully legal for recreational use in 44 states and the District of Columbia*. Additionally, 23 states permit its use for medicinal purposes.

How is Delta-9 Made?
Producing Delta-9 from hemp begins with growing or selecting high-quality and compliant hemp plants that contain 0.3% or less Delta-9 THC by dry weight.
The extraction or manufacturing method is crucial in maintaining legality while efficiently getting the desired cannabinoids for products like edibles, drinks, and tinctures. There are two main ways to produce hemp-derived Delta-9 THC. One route is through “isomerization,” a process where hemp-derived CBD is chemically rearranged into Delta-9 THC. By tweaking the molecular structure just slightly, manufacturers can transform CBD into a compound that’s chemically identical to the Delta-9 THC found in traditional cannabis. This process is rooted in well-understood organic chemistry to create a legal, hemp-derived product that delivers familiar effects.
The second common method involves extracting naturally occurring Delta-9 directly from hemp. This often happens during the distillation of other cannabinoids like CBD. Rather than chemically altering compounds, this method isolates Delta-9 in its original form. Because it’s derived straight from the plant, it’s commonly referred to as hemp-extracted Delta-9 THC. This is the form of Delta-9 that we use here at The Hemp Division.
