When it comes to cannabis, few topics spark more confusion than the difference between hemp and marijuana, especially when Delta-9 THC enters the conversation. After all, both plants come from the same Cannabis sativa species, and both can contain Delta-9, the compound known for producing cannabis’s signature “high.”

So, what actually separates them? It’s not how they look, smell, or even the type of THC they produce. The real difference lies in how much Delta-9 each plant contains and how the law defines it.

The Legal Difference

Since the passage of the 2018 Farm Bill, hemp and marijuana have existed in two different legal worlds. But as hemp-derived Delta-9 products grow in popularity, many consumers are raising the question: if the molecule is the same, does the source really matter?

Under U.S. federal law, the distinction between hemp and marijuana comes down entirely to Delta-9 THC content. Hemp is defined as any cannabis plant containing 0.3% Delta-9 THC or less on a dry weight basis, making these plants federally legal to grow, sell, and use as long as they meet this limit. While that may seem fairly straightforward, the legal landscape for hemp-derived Delta-9 is still quite nuanced. Marijuana, on the other hand, refers to cannabis plants that contain more than 0.3% Delta-9 THC. These plants remain federally controlled and are subject to strict regulations, even in states where recreational or medicinal use is allowed. Delta-9 is naturally more abundant in marijuana because these plants have been selectively bred over decades for higher THC content. This focus on potency means marijuana can produce stronger effects than hemp-derived products. 

Hemp-Derived Delta-9

Many people assume that hemp products need to be artificially enhanced to provide the effects of THC. In reality, hemp naturally contains small amounts of Delta-9 THC. To stay within federal limits, manufacturers often concentrate the naturally occurring Delta-9 to create edibles, tinctures, and other products that deliver noticeable effects while remaining legally compliant.

Even though Delta-9 is chemically identical whether it comes from hemp or marijuana, the experience may differ. Hemp-derived products, like ours, typically have lower THC concentrations, so the psychoactive effects are milder compared to marijuana.

Additionally, marijuana remains federally regulated, so access may be limited or unavailable depending on where you live. With states at the helm of production and potency, the effects vary widely depending on the strain, how it’s made, and the type of product.
